All documents that are e-filed using DelaFile are publically available to anyone who logs into the DelaFile website. The Commission and its staff assume no liability (expressly or implicitly) if any person mistakenly e-files any confidential document or confidential information as a public comment or document using the DelaFile website.
You may request that the Commission accord confidential treatment to some or all of the information contained in a document that you wish to e-file using the DelaFile website. See Section 1001-1.11 of the
for the requirements to follow for requesting such confidential treatment of documents (including the attestation required). For a listing of materials that are exempt from public disclosure, see

DO NOT E-FILE ANY CONFIDENTIAL DOCUMENT OR CONFIDENTIAL INFORMATION USING THE DELAFILE WEBSITE UNLESS YOU SIMULTANEOUSLY ALSO E-FILE 1) A REDACTED, PUBLIC VERSION OF THE SAME DOCUMENT; AND 2) AN ATTESTATION THAT THE INFORMATION IS NOT SUBJECT TO PUBLIC INSPECTION OR DISCLOSURE.
If you e-file any confidential documents without a corresponding redacted, public version and attestation, your filing will not meet the Commission�s minimum filing requirements and will be rejected. All rejected documents are not considered as legally filed documents per the Commission’s Rules and do not start any time limits set for a response from the Commission or its staff.
